Is it Really That or Is it Really This?: The Significance and Impact of Identifying Faulty Mental Health Diagnoses
Thursday August 14, 2025 1:00pm - 2:00pm EDT
Faulty mental health diagnoses refer to inaccurate or incorrect diagnoses of mental health
conditions. This session examines the long term impact of mis-diagnoses, missed diagnoses,
and the resulting collateral consequences when justice-involved clients suffer these systemic
injustices. Identifying and addressing these misdiagnoses is significant for several reasons:
1) a large majority of public defense clients are from minority and or marginalized groups who
are more likely to incur harsher sentences; 2) ensure Diversion programs are accessible and
appropriate for addressing client issues; 3) assist in reduction of recidivism by ensuring public
defense clients have culturally sensitive and unbiased assessments. When public defense
clients are faced with the loss of their freedom, public defense clinicians and mitigation
specialists are in the unique position to accomplish this social justice focused strategy.

Objectives:
1. Understand the historical context of mis-diagnoses, labels, and bias from an anti-oppressive
and anti-racist lens.
2. Examine how to exact a thorough examination of psychological, psychiatric, and other
clinical evaluations to ensure the completion of a defense-based review.
3. Conceptualize a practical “remapping” application in order to accomplish this work from a
defense-based strategy.

The Power of Stories in Trial
Friday August 15, 2025 11:30am - 12:30pm EDT
The Power of Stories in Mitigation
General Course Description
Humans use stories to make choices and justify actions. This is especially true in criminal justice, where participants automatically use stereotyping and unconscious bias on a case. This course reveals the powerful story dynamics impacting mitigation and shows how storytelling techniques saves time and effort while creating maximum impact in advocating for marginalized clients.

• What are the types of story-based biases involved in mitigation?
• What elements in mitigation are story-like, and what elements are not?
• What is the “epiphany" and why is it so powerful?
• How can you use storytelling technique to create a compelling case?

This course will answer these and other questions, covering practical storytelling techniques that you can use to create empathy and create action on your client's behalf.

Target Audience
• Criminal justice workers representing clients from marginalized populations.
• Attorneys needing to argue a case before a jury or in mitigation.
• Social workers advocating for a client’s sentencing or creating mitigation memos.

Course Values
• Empathy creates action.
• Stories and storytelling are integral to our lives.
• The justice system’s inherent biases can be corrected via storytelling.

Learning Objectives
• Understand how story creates systemic bias
• Learn the basic mechanisms of storytelling
• Explore how to apply storytelling technique in mitigation
• Use storytelling techniques to create empathy and action
